Presentation of applications for residence authorization for international mobility (Authorizations regulated by Law 14/2013, to support entrepreneurs and their internationalization)

- Law 14/2013, to support entrepreneurs and their internationalization. (Title V, Section Two, International Mobility arts. 63 to 76)
- Order PCM/1238/2021, of 12 November, publishing the Agreement of the Council of Ministers of 2 November 2021, approving the instructions determining the procedure for the entry and stay of third-country nationals active in the audiovisual sector.
Law 14/2013, of 27 September, on support for entrepreneurs and their internationalization (BOE No. 233, Saturday, September 28, 2013) regulates residence permits for certain groups of foreigners: entrepreneurs, highly qualified professionals, researchers, intra-company transfers (ICTs), international teleworkers and their families.
In accordance with article 76 of this Law, the processing of residence permits will be carried out by the Large Companies and Strategic Groups Unit, it will include the use of telematic means and its concession will be the responsibility of the General Directorate of Migration.
In compliance with this article, through this electronic office you can:
- request an initial authorisation,
- attach documentation to a pending authorization,
- correct the request by providing new documentation,
- request the renewal of your authorisation,
- consult the status of processing of your file,
- Access the notifications that have been practiced to you.
- Request the return of a fee (790 038) not applied related to a file.
The procedure is always initiated by the submission of a request by the interested party. The subject entitled to submit the application depends on the type of authorization requested:
- In the case of authorizations for international teleworker and entrepreneur the applicant will be the foreigner who will be the holder of the authorization
- In the case of authorizations for highly qualified professionals, researchers and displaced workers in an intra-company transfer, workers from the audiovisual sector or from the 37th Copa del América de Vela, the application must be submitted by the Spanish entity in which it is going to provide services abroad.
- In the case of family authorizations of a holder included in any of the above cases, the application can be submitted both by the family member himself; the entrepreneur to whom they depend or the entity that is going to hire abroad.
- In the case of renewals, the applicant will be the foreigner whose authorization is to be renewed or his parents/legal guardians in the case of minors.
In any case, the legitimate subject, whether a natural or legal person, may designate another person, natural or legal, by electronic appearance to act on their behalf in certain procedures or actions before the Public Administrations granting power through the apodera application (Electronic Registry of Apoderements, from code 201361 Aliens. Residence permits issued by the Ministry of Inclusion, Social Security and Migration)
In accordance with article 68.1 of Law 39/2015 of 1 October, if the request for initiation does not meet the requirements set forth in article 66, and, where appropriate, those set forth in article 67 or others required by the applicable specific legislation, the interested party will be required, within ten days, to remedy the lack or accompany the mandatory documents, indicating that, if he did not do so, he will be deemed to have abandoned his request.
You must take into account that when the subject legitimated to submit is a legal person, the application form (MIT models, MIF etc.) that is attached to the application must be signed electronically with a certificate of legal person's representative). To do this you can use the self-signature tool or use the electronic signature services valid@
In the event that the legitimated subject is a physical person, they may also be opcinally signed electronically through such applications.
Consult the accepted electronic signature systems.
In the event that, after the period legally established according to Law 14/2013, of September 27, no resolution of the application for residence authorization has been notified, the interested person may request resolution of the concession by silence. This request must be made by Electronic Headquarters as Application Registration >Identification by DNIe or electronic certificate > Correction.

In application of article 32.4 of Law 39/2015, of 1 October, in relation to the Agreement of the Council of Ministers of 30 April 2025, which determines the application of the extension of administrative terms and deadlines as a result of the generalized interruption of the electricity supply on 28 April 2025, which affected the correct operation of this electronic headquarters, it is agreed to extend all the deadlines not expired on the date indicated in two working days.
